All they are supposed to be able to ask is whether or not you are rehireable. But I really don’t think people really follow that rule. and I don’t know if that kind of thing varies state to state.

As an employer I’ve only been advised to answer whether or not I would hire the person again. I’m not allowed to tell anyone much more than that. I don’t know if it’s a legality reason but just something we practice here and I know was done at previous jobs.

They can ask whatever they want, but most companies will only say yes or no to whether or not you previously worked there. There’s too much risk of a lawsuit by the former employee to actually say anything else. Most employers know this, and don’t even try to ask anything else.

Nope, other then the same questions they can’t ask you. ie are you married, age (unless it’s a requirement for the job), religion, etc
